After HC rap, Maha govt files affidavit against Munna Yadav’s anticipatory bail

Nagpur Today : Nagpur News

Nagpur: The BJP government in Maharashtra has been seeing red in its face over its telling ignorance in taking action against its own party’s strongman Omprakash alias Munna Yadav, who is absconding for over five months now. Now that Nagpur bench of Bombay high court has rapped the state government over the inordinate delay in filing reply, the state government woke up from its slumber and filed an affidavit opposing anticipatory bail plea of Yadav, also a chairman of Maharashtra State Construction Workers’ Welfare Board (MSCWWB).

An affidavit by police inspector Aanchal Mudgal, attached to crime branch, contained a list of 10 offences registered against Yadav, considered close to chief minister Devendra Fadnavis.

Justice Vinay Deshpande adjourned the hearing till Friday while directing the BJP leader’s counsels led by Uday Dable, Mohit Khajanchi and Chinmay Dharmadhikari to file reply by Friday.

After rejection of his anticipatory bail petition by sessions court on March 15, Yadav knocked HC’s doors challenging the verdict. He earlier withdrew his bail application from the HC after it was about to be dismissed on February 2.

Munna Yadav and his family, including wife Lakshmi, and sons — Karan and Arjun — was booked for attacking and seriously injuring Mangal Yadav, his sister Manju, brothers — Papa and Gabbar Yadav, and others, on October 21 over a dispute on bursting firecrackers. Mangal and his kin were attacked with sword, iron rods, sticks and bricks, which left them seriously injured and were admitted to hospital. Initially, the police had booked the accused under sections 324, 325, 147, 148 and 149 of IPC, besides 307, for attempt to murder, before dropping the last offence.
Dhantoli cops had earlier declared Yadav’s family as “known criminals” in their affidavit before the court. The crime branch, however, didn’t reiterate it, but dropped the offence under Section 307 against his family as well as of the rivals, thus diluting the cases against both families.

Quoting medical reports of the injured, Mudgal said except two grievous injuries to two different victims, all other injuries are simple. On the basis of eventual outcome of investigation based on the facts and circumstances, witnesses and medical officer’s report, Section 307 is dropped from both the counter-offences and Section 326, 294, 506 of IPC were added for rioting and voluntarily causing grievous hurt. Accordingly, charge sheets under Section 299 of Criminal Procedure Code (CrPC) were submitted in the court on March 1, 2018, he said.

Opposing Yadav’s bail plea, the crime branch informed that from the spot of incident, hockey stick, stones and bamboo sticks were seized and statements of witnesses were recorded. During the course of investigation, a sword came to be seized from one of the accused Jaggu (Avdesh Nanku Yadav), which was alleged to be used by Yadav in assaulting Satya Prakash.

HC seeks AGP’s resignation

Even after facing HC’s ire on numerous occasions in the recent past, additional/assistant government pleaders (AGPs) have failed to improve their behaviour. On Thursday, when AGP attached to Munna Yadav’s case failed to remain present at 10.30am with reply, Justice Deshpande slammed him over the sorry state of affairs.

Expressing utter disappointment on GP’s office inability to file a reply to its notice even after 10 days, the upset court asked the concerned AGP to consult with the government and tender his resignation, if he couldn’t take instructions properly.

The judge even summoned GP Sumant Deopujari tersely asking him to take a note of his subordinates’ behaviour. He was also flayed for not being able to control AGPs and APPs working with his office.

On Wednesday, the HC had granted last chance to AGP to file a reply within a day while flaying him. However, when the hearing commenced on Thursday, the AGP still failed to remain present. It was only after coming under fire that the AGP filed an affidavit late in the afternoon, after which hearing was adjourned till Friday.

The AGPs and APPs are already facing the flak from Justice Rohit Deo for absence of commitment and lack of will to burn the midnight oil. He had openly stated in the order that their non-performance is particularly painful.

Kamble double murder: ACP Supare accused of trying to hush up probe to ‘save’ accused

Rashi and Usha Kamble Murder
Nagpur: The macabre Kamble double murder case has taken a curious turn as Nagpur Today senior crime reporter Ravikant Kamble, whose mother and one and half year old daughter were murdered on February 17 last, has accused the Assistant Commissioner of Police (ACP) Kishor Supare of conniving with the accused and tried to hush up the murder case at initial stage for nefarious reasons. “Moreover, the ACP ‘deliberately’ leaked the ‘case diary’ in order to weaken the investigations,” Kamble charged.

Questioning the dubious role of ACP Supare, Kamble met Commissioner of Police Dr K Venkatesham and lodged a written complaint in this connection. He has demanded the top cop to make the ACP co-accused in the double murder case. The demand by Kamble has created ripples in police circle in city.

Currently, the investigation into murders of 54-year old Usha Kamble and one-and-half year old Rashi , mother and daughter of Ravikant Kamble, is being investigated by ACP Rajratna Bansod. During the probe, ACP Bansod made the fourth arrest in the case when accused Ankit Shahu was rounded up.Cops have recovered blood stained clothes of the victims as well as a kerosene can used for burning the evidence. Gold ornaments worn by deceased Usha Kamble have also been recovered from the house of accused.

According to reliable sources, the ‘tainted’ ACP Supare, even before the investigations were completed, himself sought MCR of the accused. The ACP tried hard to prepare documents for MCR even before the end of police custody of the accused. When the ACP Supare was investigating the case, he did not bother to visit the crime spot nor house of the complainant for gathering solid clues. No nearby residents were interrogated for further clues. The ACP should have recorded the statement of the complainant Ravikant Kamble before hand to deal with the accused. All these crucial aspects were ‘deliberately’ neglected by the ACP Supare, the sources said.

Earlier cops had arrested Ganesh Shahu, his wife Gudiya and a minor boy in the case. Ganesh owns a grocery shop in Pawansut Nagar, who had brutally killed Usha Kamble and Rashi by slitting their throats with a tin plate of an oil can. Ganesh had murdered Usha and Rashi on the first floor of his house. In a bid to destroy the evidence, Ganesh along with other accused had packed the bodies in gunny bags and dumped them under a culvert near Durga Layout, behind Vihirgaon village on Umred road.

Sources further stated that even after the accused Ganesh Shahu and his wife Gudiya were sent to MCR, the ACP Supare did not feel it fit to record statement of complainant Ravikant Kamble. The ACP even ‘avoided’ gathering of circumstantial evidence such as half burned pieces of blood stained cloth burned by the accused, ash from the spot and other evidence. The ACP hesitated in seizing the CCTV footage. Ravikant Kamble has allegedly pointed out all these shortcomings in the double murder case probe to the Commissioner of Police.

Now, all eyes are on the action the top cop initiates in this regard.

The students were disembarking from the school van when the truck rammed it. Many students had lucky escape as the speed of the truck was curbed due to railing and trees around the parking area of the school. Had the truck free run the mishap would have been of terrible magnitude. The injured students were taken to Yashodha Hospital in Besa where their condition was stated to be out of danger.

Dr Sudhir Adhav of the hospital said six students of Podar International School were brought to the hospital on Saturday morning. The Principal and other teachers were accompanying the students. Two students suffered serious injuries while others had bruises. But after the treatment, all the students were out of danger. One student with fracture was referred to an orthopaedic specialist. The six students who were brought to the hospital are Satvik Shukla (7), Sukhrup Channe (12), Adi Wagh (13), Tanishk Popuri (17), Swara Jangir (13) and Navansh Wankhede (11).

The school Principal Jeenat Sayyed said that the students were coming to school as usual on Saturday morning. She had herself reached the school around 8.20 am. Whe she received information about the accident, she rushed to the parking area and took the injured students to the hospital. For the safety point of view, the parking area is at a far distance from the road. The tipper truck skiided off the road and entered the parking area of the school. When the driver was caught, he seemed to be in inebriated condition, the Principal said.

Tension ran high after the mishap as a mob of angry people pulled out the tipper truck driver and thrashed him severely. Timely intervention by police brought the situation under control and averted untoward incident. The mishap occurred under Hudkeshwar police jurisdiction. Police Inspector S B Mane had personally came to the spot. Mane said as the people suspected the driver under influence of liquor, he was taken to GMCH and his medical was done. The medical report did not confirm consumption of liquor. The PI Mane told Nagpur Today that the truck driver was patient of mirgi (fainting). The fact is being checked with the medical record of the accused driver who has been identified as Maruti Kawde (28).

The incident invited public outrage against the school van drivers who have been under radar for their incomplete verification by school authorities as well as their rough driving. “Many parents have complained to Podar school administration about mushrooming school vans without any trained drivers. But the school authorities had always lent a deaf ear to such complaints and often shrugged responsibility of this transporation off their shoulders,” said a parent whose ward was also on board one of the damaged vans.

Meanwhile, as soon as he got information about the mishap, the Guardian Minister Chandrashekhar Bawankule rushed to the spot and apprised himself about details from school administration. He also visited the injured students.

Nagpur: All is certainly not well with Empress Mall. The place has been controversy’s favorite child ever since it came into being. First it was for flouting of civic and construction norms every now then and now recently the building came under bad light after the death of three workers who lost their lives after inhaling poisonous gas while cleaning the well on the mall premises. Quite an uproar was created on Sunday as the kin and other relatives pf the deceased put the mall activities to standstill as they demonstrated with the dead bodies at the entrance lobby of the mall. The pandemonium kept the shoppers stranded for hours as they got stuck inside the mall. Even as the hullabaloo over the issue was yet to calm down, yet another alarming incident cropped up to keep Empress Mall below the clouds. A lady doctor has alleged that she was molested in the lift, while the lady guard remained a mute spectator to the entire incident.

Venting her ire on social media, the victim Dr Vishakha Bharati posted, “Today I came across two hopeless charracters in Empress Mall.”

She added, “As the lift approached ground floor I was finding my way to get out of the lift but this hopeless person (trying to force enter the lift) pushed and thrown me back into the lift.”

Dr Bharati said that this person did not even bother to let the people come out first. When she objected to his behaviour, he picked up an argument and pushed her again and thrown her out of the lift. Dr Bharati also got injured in the scuffle.

She said that the lady guard was observing all this from outside but did not even reacted.

The person in question allegedly molested her and her friend but the lady guard refused to intervene as she flatly replied that this was not her job to look into such matters.

“I wonder what her job is,” Dr Bharati questioned in her FB post, adding that being a woman the lady guard could have helped her but she chose to remain ignorant.

Dr Bharati also made a point to recall the words spoken by this unruly goon. The man allegedly said to Dr Bharati, “Ja jo karna hai kar lena…ye jagah meri hai, mujhe batayegi kya..?” (Do whatever you want…this is my place… now would tell me …?)

In her post Dr Bharati has also demanded strict action against such elements as well as the lady guard who refused to do his duty.
